Claire-Naa online store was set up by DESIGN'NAA which is the operator of this website. Any order taken for a product listed in the online shop on the website www.claire-naa.com requires prior consultation of these general conditions.
Article 1: Purpose
The purpose of these general conditions is to define the rights and obligations of the parties in connection with the online sale of goods and services offered by DESIGN'NAA to the customer. They regulate all the stages necessary for placing the order and ensure the follow-up of this order between the contracting parties.
The contract, resulting from the order, is composed of the following contractual documents, presented in decreasing hierarchical order: these general conditions and the purchase order form. In case of contradiction between the measures contained in documents of different rank, the provisions of the document of higher rank shall prevail.
The general terms of sale may be subject to changes, the applicable conditions are those in force on www.claire-naa.com on the date of placing the order by the customer.
To this end, the customer has the option of downloading, saving and reproducing these general conditions, it being specified that both saving and editing this document is the sole responsibility of the customer.
Article 2: Products
2-a: The products offered for sale by DESIGN'NAA are those appearing on the site www.claire-naa.com, on the day the customer consults the site.

2-b: The offers presented by the company DESIGN'NAA are valid only within the limits of available stocks.
Article 3: Prices
The prices are presented in euros (€), all taxes included, excluding delivery costs which remain the responsibility of the customer and which are indicated before the validation of the order, except mentions or particular conditions. All orders, whatever their origin, are payable in euros.
Prices include VAT applicable on the day of the order and any change in the applicable VAT rate will be automatically reflected in the price of products in the online store. The payment of the totality of the price must be realized at the time of the order.
The company DESIGN'NAA reserves the right to modify its prices at any time. Products will be invoiced on the basis of the prices at the time the order is placed.
Article 4: Order
Prior to his order, the customer declares:
_to have the capacity to conclude this contract, i.e. to be at a legal age and not be under guardianship or trusteeship,
_not to purchase products on www.claire-naa.com to resell them.
The customer also declares to have read and irrevocably accepted these general conditions of sale, before placing his order.
Any order taken implies acceptance of the prices and descriptions of the products available for sale and the validation of the order implies acceptance of these general conditions of sale.
The "double click" of the customer under the purchase order constitutes an electronic signature which has, between the parties, the same value as a handwritten signature; the order is then considered irrevocable.
The contractual information will be confirmed by e-mail at the latest at the time of delivery or failing this, at the address indicated by the consumer on the order form. The consumer can, at his request, obtain the sending of an invoice to the billing address and not to the delivery address by validating the option provided for this purpose on the order form.
The computerized registers, kept in DESIGN'NAA's computer systems under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties. The archiving of purchase orders and invoices is carried out on a reliable and durable support, which can be produced as proof.
Article 5: Methods of Payment
5-a: To pay for his order, the consumer has, at his choice, all the payment methods referred to within the order form. The consumer guarantees DESIGN'NAA that he has the necessary authorizations to use the payment method chosen by him when validating the order form.
5-b: The company DESIGN'NAA reserves the right to suspend any order management and any delivery in case of any refused payment by credit card from officially accredited organizations or in the event of non-payment. DESIGN'NAA also reserves the right to refuse to make a delivery or to honour an order from a consumer who has not fully or partially settled a previous order or with whom a payment dispute is under administration.
In order to protect itself against fraud attempts, DESIGN'NAA records the following information: IP address, dates and times of the transaction. These elements formally and uniquely identify the transaction. This information will remain confidential if no fraud attempt is made.
Any attempt at fraud, for whatever amount and whatever the origin, will be subject to criminal prosecution. All the data collected during the transaction concerning you will then be forwarded to the Public Prosecutor's Office for investigation.
5-c : The security system set up for payment by credit card is the system of the Caisse d'Epargne: Paybox System. Personal information as well as credit card numbers never pass in clear on the Internet network, the data are signed, encrypted and transmitted by the SSL protocol (SSL Certificate) before the telepayment module. The agreement of the central credit card network validates the payment.
DESIGN'NAA never has access to your credit card number.
Article 6: Availability of Products
The order will be executed at the latest within 30 days from the day following that one which the consumer placed his order. In case of unavailability of the ordered product, in particular because of our suppliers, the consumer will be informed as soon as possible and will have the possibility to cancel his order. The consumer will then have the choice to request either the refund of the sums paid within 30 days at the latest of their payment or the exchange of the product
Article 7: Terms of delivery
7-a : Contact information
The customer must check the completeness and conformity of the information he provides when ordering, in particular concerning the delivery address.
DESIGN'NAA cannot be held responsible for any input errors and the resulting consequences (for example delays or delivery errors). In this context, the costs incurred for the re-shipment of the order would be at your expense.
7-b : Delivery
DESIGN'NAA reserves the carrier's choice and guarantees the proper delivery of products.
As far as shipping is concerned, we mainly work with Colissimo Suivi. As soon as DESIGN'NAA sends a shipment, the customer immediately receives an informative e-mail.
In addition to being economical, the Colissimo Suivi service offers you the possibility of recovering the products ordered at your post office closest to the delivery address in the event of absence of the initial place of delivery at the time of presentation of the postman. In concrete terms, if you are absent the day of delivery, your postman will leave a notice in your mailbox, which will allow you to collect your parcel at your post office during opening hours, within 15 days.
However, it is possible, as in any shipment, that there may be a delay in delivery or that the product gets lost. In the event of delay of delivery compared to the date that we indicated to you in the mail of forwarding, we ask you to announce us this delay by calling us by telephone or by sending us e-mail. We will then contact the Post Office to start an investigation. A Post investigation may last up to 21 days from the date of commencement of the investigation. If during this time, the product is found, it will be immediately re-routed to your home (most cases). If the product is not found after 21 days of investigation, the postal services La Poste considers the package lost. Only then can we send you a replacement product, at our expense. If the product(s) ordered were no longer available at this time, we will refund the amount of the products affected by the loss of the carrier. If the product(s) were still available, but had changed selling prices on the site, we would apply the new selling prices, either by refunding you by check for the difference, or by asking for an additional check concerning this price difference. We decline any responsibility as for the extension of the delivery times because of the carrier, in particular in the event of loss of the products or strike.
The products remain the property of DESIGN'NAA until the date of purchase.
7-c : Delivery problems due to the carrier
The customer is responsible for checking the condition of the packaging and the conformity of the product delivered.
Any anomaly concerning the delivery (damage, missing product compared to the delivery order, damaged package, broken products...) must be imperatively indicated on the delivery order in the form of "handwritten reserves", accompanied by the signature of the customer. The consumer must at the same time confirm this anomaly by sending the carrier within two (2) working days following the delivery date a registered letter with acknowledgement of receipt stating the said claims. The consumer must send a copy of this letter by fax or by post to DESIGN'NAA, within one week to:

If this procedure is not respected, DESIGN'NAA is released from any responsibility on possible exchanges or refunding of products.
7-d: Delivery times
Orders placed before 12pm are generally shipped the same day (excluding weekends).
The average delivery time is 3 days (excluding Sunday).
Custom products require an additional 30 days due to workshop operations
7-e: Localities served
The deliveries are made in metropolitan France (Corsica included) as well as in all the international countries.
7-f: International delivery
The products offered comply with the legislation and standards applicable in France.
For any purchase for export, you must check the specificity of the legislation in force in the country concerned, whether for taxes, declarations or prohibitions.
DESIGN'NAA cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with the local authorities the possibilities of importing or using the products.
7-g : Shipping costs
A contribution to the shipping costs is charged extra. This participation may be reduced or eliminated depending on ongoing business operations.
The shipping costs are calculated before the validation for acceptance of your order.
Article 8: Right of withdrawal - Exchange and refund
Beyond the legal withdrawal period of 14 clear days (Article L121-20 of the Consumer Code "the consumer has a period of fourteen clear days to exercise his right of withdrawal without having to justify reasons or pay penalties, except, where appropriate, return costs"), DESIGN'NAA reserves the right to refuse the exchange or refund.
Products made according to the specifications of the consumer or clearly personalized (engraving, sizing) are neither taken back nor exchanged except if it is a question of a return following the delivery of a product not co-form compared to the order, and where the customer could not be deprived of the faculty of return of the product, even if this last was personalized.
The exchange or refund request must be made to DESIGN'NAA by telephone on 06 61 99 52 14 from Monday to Friday from 9am to 7pm.
Any request not made in the rules defined above will release DESIGN'NAA from any responsibility towards the customer.
Any return of goods requires the prior agreement of DESIGN'NAA and the obtaining of a number of returns delivered by this one to the customer, which must be very legibly registered on any returned parcel.
The return of goods is made at the expense, risk and peril of the customer. DESIGN'NAA therefore recommends delivery with delivery against signature and package insurance. Products returned by carrier without physical protection or poorly protected will be refused. It is therefore the customer's responsibility to protect and insure the product(s) returned during transport.
Thus, any product to be exchanged or refunded must be returned to DESIGN'NAA as a whole and in its original packaging to the following address:

The returned item must be unworn and accompanied by a copy of the purchase order or invoice and informally, note the reason for return, so that we can improve our service. Products returned damaged, soiled or incomplete will not be exchanged or refunded.
The refund of the article will be carried out with reception of this one. This reimbursement is made by any means of payment. However, on the proposal of DESIGN'NAA, the customer may opt for another method of refund.
If a discount code is used when ordering, the amount refunded will take this discount into account.
The item will be exchanged within 30 days from receipt at DESIGN'NAA.
The customer will have to join with his return a fixed check of 5,95 € for the expenses of preparation and sending of the new chosen article.
If the new order is of a higher amount, the customer will have to join to the request of exchange the payment of the remainder. Conversely, if the amount of the exchange is less than the initial amount, the customer will be refunded the amount of the difference.
In case of delivery error
If a delivery error has been made in relation to the order, DESIGN'NAA will bear the return costs by sending a Colissimo Return Voucher that the customer must stick on the package before bringing it to his post office if the customer made the return by its own means, DESIGN'NAA will refund the customer a flat-rate amount of 5.95 €.
Article 9: Right of withdrawal
From the date of receipt or withdrawal of his order, the customer has a period of 14 days to announce his decision to withdraw and return, at his expense, products that do not suit him.
This period runs from the day of delivery of the consumer's order. If this period expires on a Saturday, Sunday or public or non-working day, it is extended until the next working day. After this period, the products delivered will be deemed compliant and accepted by the customer and DESIGN'NAA reserves the right to refuse the exchange, credit or refund.
Any return must be notified in advance to the DESIGN'NAA Customer Service: - preferably by telephone on 06 61 99 52 14 from Monday to Friday from 9am to 7pm.

Only products returned in their entirety, in their original packaging complete and intact and in perfect condition for resale will be taken back. Any product that has been damaged or whose original packaging has been damaged will not be refunded or exchanged.
According to the law, products made according to the consumer's specifications or clearly personalized (engraving, sizing) are excluded from the right of withdrawal unless it is a return following the delivery of a product that does not conform to the order, and where the customer cannot be deprived of the right to return the product, even if the product has been personalized.
The right of withdrawal is exercised without penalty, with the exception of return costs. In the event of exercise of the right of withdrawal, the consumer has the option of requesting either a refund of the sums paid or the exchange of the product. In the case of an exchange, re-shipment will be at the consumer's expense.
In case of exercise of the right of withdrawal, DESIGN'NAA will make every effort to reimburse the consumer within 14 days (Article L121-21-4 of the Consumer Code "When the right of withdrawal is exercised, the trader is required to reimburse the consumer for all sums paid, including delivery costs, without undue delay and no later than fourteen days from the date on which he was informed of the customer to retract ». The consumer will then be paid off by recredit of his bank account (secure transaction) in case of credit card payment or by check in the other cases.
Article 10: Product Warranty
The jewels are guaranteed one year except contrary indications at the level of the sheet article. The guarantee is limited to the value of the article and is valid only if the product is used for its intended use and under normal conditions of use. The warranty does not cover damage caused by normal wear and tear due to regular use, poor maintenance, improper use, wear and tear due to friction, exposure to extreme temperatures, acids (including the very high acidity of certain skins), solvents and chemicals.
The product will be exchanged within 14 days of receipt by DESIGN'NAA.

Article 11: Force Majeure
Neither party shall have failed in its contractual obligations, insofar as their execution is delayed, hindered or prevented by a fortuitous event or force majeure. Will be considered as fortuitous event or force majeure all facts or circumstances irresistible, external to the parties, unforeseeable, unavoidable, independent of the will of the parties and which cannot be prevented by the latter, despite all reasonably possible efforts. The party affected by such circumstances shall notify the other within ten working days of the date on which it becomes aware of them. The two parties will then, within a period of one month, unless it is impossible due to force majeure, to examine the impact of the event and agree on the conditions under which performance of the contract will continue. If the case of force majeure lasts longer than three months, the injured party may terminate these general conditions. Expressly, are considered as cases of force majeure or fortuitous events, in addition to those usually retained by the jurisprudence of French courts and tribunals: the blocking of means of transport or supplies, earthquakes, fires, storms, floods, lightning; the shutdown of telecommunication networks or difficulties specific to telecommunication networks external to customers.
Article 12: Intellectual Property
All elements of the www.claire-naa.com site, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents.
Any total or partial reproduction of these elements is strictly prohibited without written permission from DESIGN'NAA.
The user who has a personal Internet site and who wishes to place, for a personal use, on his site a simple link referring to a page of the site www.claire-naa.com must request the authorization from the company DESIGN'NAA. This will not be an implied affiliation agreement.
On the other hand, any hypertext link referring to the www.claire-naa.com site and using inclusion by frame or by transclusion is in any case formally prohibited.
In all cases, any link, even tacitly authorized, must be removed upon simple request from DESIGN'NAA.
Article 13: Applicable Law - Disputes
13-a: These general conditions of sale are subject to French law regardless of the country of delivery.
In the event of a dispute arising from the present contractual relationship, the client and DESIGN'NAA undertake before any legal action to seek an amicable solution.
The nullity or the illicit character of one of the clauses of the present general conditions of sale will not carry the nullity of these conditions; the clause to be inserted to replace that cancelled will be that in force.
13-b: If one or more provisions of these general conditions are held to be invalid or declared such pursuant to a law, regulation or following a final decision of a competent court, the other provisions shall retain all their force and scope.
13-c: The fact that one party does not rely on a breach by the other party to any of the obligations referred to in these general conditions shall not be interpreted in the future as a waiver of the obligation in question.
13- d: In case of difficulty of interpretation between any of the headings of the clauses, and any of the clauses, the titles will be declared non-existent.
Article 14: Liability
Hypertext links may refer to other websites. DESIGN'NAA declines all responsibility in the event that the content of these sites contravenes the legal and regulatory provisions in force.
DESIGN'NAA cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses, or any fact qualified as force majeure, in accordance with case law.
Article 15: Data Processing and Individual Liberties
DESIGN'NAA is aware of the importance of protecting the privacy of its own users and customers and undertakes not to disclose the information provided to third parties. These are confidential. They will only be used by our internal services for the processing of your order (customer file) and only to reinforce and personalize the communication and the offer reserved for customers, in particular by the newsletter of www.claire-naa.com.
In accordance with the law n°78-17 of January 6, 1978 relating to data processing, files and freedoms, the treatment of the personal information collected on the site www.claire-naa.com was the object of a declaration near the National Commission of Data processing and Freedoms under the n°1431475. The customer has a right to access, modify, rectify and delete data concerning him.
